Terms & Conditions of sale

Private United Kingdom customers have certain cancellation rights under the Consumer Protection (Distance Selling) Regulations 2000 (the Regulations). Teknos (UK) Limited offers the following returns policy:

1. Returns of unopened and untinted (white only) items are accepted within 28 days from date of delivery with a valid proof of purchase.

2. Returns of damaged, defective or incorrect items are accepted within 28 days from date of delivery with a valid proof of purchase.

3. Tinted (coloured) paint cannot be returned.

4. Any customer wishing to make a return must notify Teknos (UK) Limited by telephone +44 (0)1869 208 005 or by email to sales@teknos.co.uk

5. As a further condition of the right to return, customers must also arrange (at their own expense) to return the goods in a saleable condition to 7 Longlands Road, Bicester, Oxfordshire, OX26 5AH as soon as possible. If Teknos (UK) Limited pays the return cost then this will be deducted from any refund. In the case of defective, damaged or incorrect orders, Teknos (UK) Limited will arrange for free return of the goods. The goods will be deemed returned when actually received by the vendor at the said address. Alternatively items can also be returned in person (at no cost) to the address stated above.

6. Pending the return of the goods they must be kept in good condition.

7. Where goods delivered by the vendor are received by the customer damaged, the vendor must be notified within 24 hours of delivery in order for replacement goods to be re-sent free of charge. No such claims will be accepted after the 24 hours has elapsed.

8. On occasion, an item may be mispriced. If you purchase a mispriced item, we reserve the right to cancel the contract and relist the product at the correct price.

We reserve the right to cancel any order at any time prior to delivery, for any reason - No contract of sales exists until your order is verified by a member of staff. Our initial order status, ‘Processed’ does not mean that a contract of sale is in place. This only means that the order has been successfully received into our system. From there on, validity and verification must take place before the contract of sale exists. Further, we reserve the right to degrade the order status to 'Declined' should our order become unacceptable for any reason.

The contract made between the customer and Teknos (UK) Limited through any transaction is governed by UK law, using only the English language.

DISCLAIMER

Teknos (UK) Limited shall have no liability to Customer for:

1. Any loss or damage to property or personal injury caused by the negligence of the Customer, including but not limited to failure by the Customer to use the Products in accordance with the Product Data Sheet, failure to wear appropriate protective clothing and/or failure to adequately ventilate the site being painted.

2. Any information provided in respect of the Products by Teknos (UK) Limited that is inconsistent with the Product Data Sheet; and/or

3. Any errors in coverage rates quoted or otherwise supplied. Customer agrees that coverage depends on the condition of the substrate, surface absorption, texture and application method.

FORCE MAJEURE

1. Teknos (UK) Limited shall not be liable for any failure to comply with the Contract related to any circumstances whatever (whether or not involving Teknos (UK) Limited negligence) which are beyond Teknos (UK) Limited reasonable control and which prevent or restrict Teknos (UK) Limited from complying with the Contract.

2. Teknos (UK) Limited may where reasonable in all the circumstances (whether or not involving Teknos (UK) Limited negligence) without liability suspend or terminate (in whole or in part) its obligations under the Contract, if Teknos (UK) Limited ability to manufacture, supply, deliver or acquire materials for the production of the Products by Teknos (UK) Limited normal means is materially impaired.

Teknos respects the integrity of every person who visits Teknos’ website. The privacy policy outlines how and why Teknos can collect information and utilise the collected information.

4.2 Personal data

Teknos does not collect identifiable personal data (i.e. user’s name, address, telephone number, or e-mail address) via Teknos’ website, unless the user has personally provided such data to Teknos, and given an explicit consent for processing of such data. If the user does not wish to have his/her personal data registered, the user must refrain from providing this information to Teknos.

Personal data collected by Teknos may include the following types of personal data and their changes and is always separately based on the nature of the relationship and collaboration between Teknos and the data subject in question:

First name, last name, title, job and / or other work-related information, telephone number, email address, postal address, age bracket, gender, company name represented by the registered person.

4.3 Purpose and legal grounds for processing personal data

If the user provides his/her personal data to Teknos, Teknos may store and subsequently process this data to understand the user’s specific needs, and thereby improve Teknos’ products and services. Teknos or a third party, e.g. a fulfilment centre, may use the information to contact the user and/or can offer third parties non-identifiable personal data about visitors to Teknos’ website.  The processing of personal data is based on the legitimate interest of Teknos or the explicit consent given by the data subject.

4.4 Other data

Teknos will occasionally automatically collect information that is not personally identifiable, e.g. the user’s browser type and operating system, as well as the domain name from which the user came when the user visited Teknos’ website.

4.5 Cookies

Teknos uses cookies to gather information concerning the use of our websites. Teknos also uses so-called session cookies to save information about choice of language. These are, however, deleted automatically. Teknos does not save any sensitive personal information.

4.6. Regular sources of information

Most of the information concerns the data subject or the company he/she represents. Personal data can also be collected from third parties like organizations, which organize different events or activities related to painting.

4.7 Regular data transfers outside of EU or European Economic Area (EEA)

Teknos uses external service providers in processing personal data who process personal data on behalf of Teknos for the purposes mentioned in this privacy policy. Teknos guarantees that outsourcing happens according to the applicable law. The external service providers may only use the personal data for the provision of agreed services to Teknos and under the terms agreed with the Teknos.

In handling your personal data, Teknos uses service providers, servers and resources located in many different countries. To some extent personal data is also transferred to other Teknos Group companies. Teknos also transfers your personal data to countries outside the EU and EEA, where data protection legislation differs from European law. Teknos guarantees that the transfer of data is legitimate and that the personal data is protected in accordance with the applicable laws by using, in particular, the European Commission's relevant Standard Contractual Clauses for data transfer outside the European Economic Area.

4.8 Retention period for personal data

Personal data will be kept for as long as necessary taking into account Teknos’s business needs and in accordance with the local applicable legislation.

4.9 Principles of protection of personal data

Teknos guarantees the security of data collected through the use of appropriate technical and organizational measures.

Only authorized representatives of Teknos and authorized external service providers acting on behalf of Teknos have the right to process personal data. Teknos has granted limited access to personal data only to persons who need this access. The system is protected in accordance with Teknos's security policy.

4.10 Your personal data rights

You have the right to request a copy of your personal data in the register. The request must be made in writing to the e-mail address mentioned in this privacy policy.

You also have the right to prohibit Teknos from using your personal information if there is no legal basis for processing your personal data. You also have the right to request Teknos to restrict the processing of your data. Additionally, you have the right to request Teknos to correct incorrect information and to request Teknos to erase information about you. Requests for the above items must be made to the above mentioned contact details. You also have the right to file a claim regarding the processing of your personal data to the data protection authority.
